Safety ALRT |Terms of Use

1. Who We Are

These Terms of Use (Terms) govern your use of the Safety ALRT mobile application and website (together, Safety ALRT or the Service). The Service is operated by Safety ALRT Pty Ltd (we, us, our):

By accessing or using Safety ALRT, you agree to these Terms and our Privacy Policy. If you do not agree, you must immediately cease using the Service.

2. Critical Warning | NOT AN EMERGENCY SERVICE

  • DO NOT RELY ON THIS APP AS YOUR PRIMARY SOURCE OF EMERGENCY INFORMATION.

  • Safety ALRT is a secondary information tool providing general hazard data only.

  • In a life-threatening or time-critical emergency, always call 000 (Triple Zero) or your local emergency number immediately.

  • Always follow the directions of official emergency authorities (RFS, SES, Police) regardless of information shown in the App.

3. Eligibility and Age Restrictions

3.1 Age Restriction: Safety ALRT is an age-restricted platform for users aged 16 and over, in compliance with the Online Safety Act 2021 (Cth).

 

3.2 Verification: We use "Email Age Inference" via your Login Provider to confirm your age range. We do not store your private email data or government IDs for this purpose. Any data used for this check is destroyed immediately after verification.

 

3.3 Account Security: You are responsible for maintaining the security of your third-party login (Google/Microsoft). We are not liable for unauthorized access to your account.

4. User Alerts and Content

4.1 You agree to use Safety ALRT lawfully and respectfully. You must not:

  • Post false, misleading, or hoax reports. This is a material breach of these Terms.

  • Share personal information about identifiable individuals (names, addresses, license plates).

  • Harass, stalk, or threaten other users.

  • Attempt to bypass security features or reverse-engineer the App.

  • Termination: We reserve the right to suspend or terminate your account immediately, without notice, if we believe you have posted hoax alerts or breached these conduct rules.

4.2 Anonymous Reporting Does Not Mean Untraceable: While your reports appear anonymous to other users, we maintain internal records linking reports to accounts. We may disclose your identity to:

  • Law enforcement agencies with valid legal requests

  • Emergency services if we believe there is an imminent threat to life or safety

  • Courts pursuant to subpoena or court order

Posting hoax alerts or misusing the anonymous reporting feature may result in account termination and, where appropriate, referral to authorities.

4.3 Traceability of Anonymous Reports: 

While your reports appear anonymous to other users, we maintain internal 
records linking reports to accounts. We may disclose your identity to:

  • Law enforcement agencies with valid legal requests

  • Emergency services if we believe there is an imminent threat to life or safety

  • Courts pursuant to subpoena or court order

Deliberate misuse of the anonymous reporting feature (including hoax alerts, harassment, or spam) may result in account termination and 
referral to authorities.

5. User Generated Content

5.1 Responsibility and Permanence: 
You are solely responsible for the accuracy of alerts you submit. 

Important: Once submitted, reports cannot be edited or deleted by you. 
This ensures the integrity of real-time safety information. If you believe a report should be removed, contact support@safetyalrt.com.

 

Anonymous Does Not Mean Consequence-Free:

While other users cannot see your identity, we maintain internal records linking reports to your account. 
False or hoax reports may result in:

  • Immediate account suspension or termination

  • Referral to law enforcement where appropriate

  • Legal liability under applicable laws

5.2 License to Use Content: 
By posting content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display that content for the 
purposes of:

  • Operating and improving the Service

  • Maintaining historical safety data archives

  • Complying with legal obligations

  • Training safety prediction models

Due to the safety-critical nature of hazard data, this license continues even after account deletion where necessary to maintain historical safety records or comply with legal requirements.

 

5.3 Moderation Rights: 
We may monitor, remove, or modify content that we deem:

  • Inaccurate, misleading, or fraudulent

  • Harmful, harassing, or threatening

  • In violation of these Terms

Moderation is conducted for technical and safety purposes only and does not imply that we endorse, verify, or take responsibility for any 
user-submitted content.

5.4 No Verification: 
User-submitted alerts are unverified and should be treated as indicative information only. Always cross-reference with official sources.

6. Data Sources and No Affiliation

6.1 Unofficial Service: Safety ALRT is an independent platform. We are not affiliated with, endorsed by, or an official arm of any government agency.

6.2 Accuracy of Summaries: Summaries and visualizations are unofficial. You must always click the provided links to the original official source for authoritative instructions.

 

6.3 Data Attribution: We acknowledge the following data providers:

  • NSW RFS: © State of New South Wales (NSW Rural Fire Service).

  • Transport for NSW: Data courtesy of Transport for NSW (CC BY 4.0).

  • ACT Government: © Australian Capital Territory (CC BY 4.0).

  • GDACS: Data provided by GDACS (CC BY 4.0).

7. Technical Limitations

7.1 Notification Delivery: Alerts depend on third-party networks (Apple, Google, and ISP networks). We do not guarantee that notifications will be delivered, or delivered in a timely manner.

 

7.2 Location Data: Location services are optional. We use generalized (suburb-level) data where possible. Continuous background use of GPS can significantly decrease battery life.

 

7.3 External Links: We are not responsible for the content or availability of external websites linked within the App.

8. Fees and Changes to Service

Safety ALRT is currently provided at no cost. We reserve the right to:

  • Introduce paid features (e.g., badges, avatars, or advanced data feeds) with 30 days' notice.

  • Modify or limit specific data features (like Air Quality) to comply with third-party commercial licensing requirements.

9. Limitation of Liability

9.1 Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any guarantee or right you have under the Competition and Consumer Act 2010 (Cth).

9.2 General Limitation:
(a) To the maximum extent permitted by law (and subject to clause 9.1), Safety ALRT Pty Ltd is not liable for any indirect, consequential, special, or incidental loss or damage arising from your use of the Service.
(b) Our liability for any breach of a consumer guarantee that cannot be excluded is limited, at our option, to: - Re-supply of the services; or - Payment of the cost of having the services re-supplied.
(c) We exclude all liability for loss, injury, or damage resulting from:

  • Your reliance on any information or user-generated alert

  • Delayed or failed notifications

  • Any errors, omissions, or inaccuracies in data provided

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of NSW.
